Although creating a safety, security and violence prevention plan may seem like an overwhelming task, this aspect of running a business is not an option or a luxury any longer. Courts have consistently ruled that business owners have a moral and legal responsibility to keep employees, clients, customers and visitors safe.
We recommend that you consult with your Human Resources Department or Legal Advisor regarding the implementation of a workplace harassment and violence prevention program. Our seminars, services and products are based on our expertise related to violence prevention and should never be construed as legal advice. However, we utilize the following principles as a basis for our training and encourage you to consider and research them as you evaluate the need to implement a workplace violence prevention program:
General Duty Clause: Under Section 5(a)(1) of the Occupational Safety and Health Act, employers are expected to provide "a place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to employees." Due to the rise of violence in the workplace, OSHA has begun to issue citations for workplace violence under the general duty clause.
Outside Party: If an employee is victimized by an outside party (while working), an employer may be liable for damages, especially if the employer has taken no action to provide safety education or prevent workplace violence incidents.
Vicarious Liability: Employers shoulder the responsibility for the safety of their employees while they are traveling or working away from the office. OSHA defines the workplace as "any location, either permanent or temporary, where an employee performs any work related duty. This includes, but is not limited to, the building and surrounding perimeters (including parking lots), field locations, client's homes and any work related travel away from the office or to and from work assignments.
Negligent Hiring: Pre-employment screening has become a critical safeguard for employers who wish to avoid or reduce liability for damages arising from an employee's improper conduct or criminal actions.
Without exception, the term "workplace violence" creates images of mass murders and rampage shootings in our minds. It is true that these episodes are the most traumatic and the most publicized, but they are only a small segment of the global issues that fall under the category of "workplace violence".
